Notice elements

A notice should identify the copyrighted work, identify the challenged material with a precise URL, provide the sender’s contact details, and include a good-faith statement that the use is not authorized by the owner, agent or law.

It should also state under penalty of perjury that the information is accurate and that the sender owns the right or is authorized to act for the owner, followed by a physical or electronic signature.

Counter-notice

A counter-notice generally identifies the affected material and former location, gives contact details, states under penalty of perjury that removal or restriction resulted from mistake or misidentification, includes required jurisdiction and service consents, and bears a physical or electronic signature.

Repeat infringement and accuracy

Where appropriate and technically possible, access connected to repeated infringement may be restricted. Material misrepresentations may create liability. Use the reporting worksheet for non-copyright safety categories rather than presenting them as DMCA claims.
